Solicitud de aclaración de la Sentencia C-390/23, formulada por la Agencia de Defensa Jurídica del Estado.
Encontró la Corte que la peticionaria carece de legitimación en la causa pues no alcanzó a constituirse como un interviniente del proceso.
Ello, porque presentó el correspondiente escrito un mes después de que venciera el término de fijación en lista previsto en el inciso 2º del artículo 7º del Decreto Ley 2067 de 1991 y, por ello, perdió la oportunidad de constituirse como partícipe de la causa.
Se RECHAZA la aclaración formulada y se reitera a la Agencia peticionaria que no presentó intervención oportuna dentro del proceso que terminó con la expedición del fallo de la referencia.
